1. Acceptance of Terms

By accessing and using the Fusion Used Engines & Transmission Inc. website or placing an order for any product, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.

2. Products and Descriptions

All used engines and transmissions sold by Fusion Used Engines & Transmission Inc. are pre-owned automotive components. While we make every effort to accurately describe each product:

• All engines are sold as long-block assemblies unless otherwise stated on the invoice
• A long block includes: cylinder head, engine block, and all internal components
• Bolt-on accessories left on the long block are not covered by warranty unless noted
• Product descriptions are based on inspection findings at time of listing; minor variations may exist
• We confirm compatibility using your VIN before completing any order
• OEM parts may be interchangeable across multiple years, makes, and models as determined by OEM standards

3. Pricing and Payment

• All prices are displayed in US Dollars and are subject to change without prior notice
• Payment is required in full at the time of order unless otherwise arranged
• We accept major credit cards and approved payment methods as displayed at checkout
• All deposits are non-refundable once order processing has begun
• We reserve the right to cancel any order if payment cannot be verified

4. Shipping and Delivery

• We deliver to commercial and residential addresses anywhere in the continental United States
• Commercial address shipping is provided free of charge
• Residential shipping is also free; a $100 forklift charge applies at residential addresses requiring lift service
• Order processing time is 3–5 business days for verification and palletization
• We are not responsible for delays caused by shipping carriers, weather, or unforeseen circumstances
• Risk of loss transfers to the buyer upon delivery to the designated address

5. Inspection and Defects

• Upon delivery, you must inspect the product within 7 days and notify us of any damage, defects, or incorrect items
• Failure to notify us within 7 days of delivery constitutes acceptance of the product as-is
• Notify us immediately of any visible shipping damage; retain all original packaging for carrier claims

6. Warranty

All warranty terms are governed by our separate Engines Warranty Policies and Transmission Warranty Policies documents. Key warranty conditions include:

• Warranty coverage begins on the date of delivery
• Warranties cover internal parts only — no labor, freight, or consequential costs
• Warranty is void if the product is disassembled, modified, or improperly installed
• Customer must complete all pre-installation requirements to maintain warranty validity
• Warranty is non-transferable and applies to the original purchaser only

7. Returns and Refunds

Returns are governed by our Refund Policy. In general:

• We offer a 7-day return window from the date of delivery for uninstalled parts
• Parts must be returned in original, uninstalled, unmodified condition
• All returns must be pre-approved — contact us before sending any item back
• Items returned not in the same condition as shipped will not be refunded

8. Limitation of Liability

To the maximum extent permitted by law, Fusion Used Engines & Transmission Inc. shall not be liable for:

• Indirect, incidental, special, or consequential damages arising from use of our products
• Loss of use, revenue, or profits resulting from product failure
• Labor, diagnostic, towing, or rental costs under any circumstances
• Damages exceeding the original purchase price of the product

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these terms shall be resolved exclusively in the courts located in Austin, Texas.

10. Modifications

Fusion Used Engines & Transmission Inc. reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the revised terms.
